Article 1 – Purpose

These conditions govern sales by   lespatisnormandie.fr  of short-term furnished apartment nights.


Article 2 – Accommodation Contract

The tenant, signatory of the booking contract, established for a specified number of people and rooms as well as a determined duration, may not, under any circumstances, claim the right to remain in the premises beyond this period.

If the number of people (including children and infants) exceeds the number specified in the booking confirmation, the owner reserves the right to refuse additional tenants.


Article 3 – Use of the Reserved Space

The user must be at least 18 years old, have the legal capacity to contract, and use the site in accordance with the Terms and Conditions of Sale. They are financially responsible for their actions, except in cases of fraud, for which they must provide proof. The user also guarantees the accuracy and truthfulness of the information provided about themselves in the reservation space made available to them.

Article 4 – Reservation Process

Reservations can be made by email, phone, or directly online through the website. www.lespatisnormandie.fr. The reservation becomes effective upon receipt by the owner of a 30% deposit of the total stay amount. The prices include all charges, excluding the tourist tax. Once the deposit is paid, the tenant will receive a reservation confirmation via email, which will include essential details such as the description of the reserved services and the price.

The payment of the deposit constitutes full and complete acceptance of the terms and conditions outlined in this document.


Article 5 – Cancellation of Reservations

Cancellation by the tenant:

Cancellation must be communicated by email, mail, or phone.

In accordance with current regulations (articles L.121-20-2 and L.121-20-4 of the French Commercial Code), the right of withdrawal does not apply to accommodation services.

In case of cancellation by the tenant, the following conditions apply:

Cancellation conditions for gîte stays:

  • For a cancellation more than 30 days before arrival: 30% of the total stay amount is due.
  • For a cancellation between 30 and 15 days before arrival: 80% of the total stay amount is due.
  • For a cancellation between 15 days and 1 week before arrival: 90% of the total stay amount is due.
  • For a cancellation less than 1 week before arrival: 100% of the total stay amount is due.
 

No-show of the tenant at the guesthouse or gîte: : 100% of the total stay amount is due.

In the case of an early departure, the full stay amount remains due.


The owner reserves the right to claim the remaining balance from the tenant, depending on the circumstances.


Cancellation by the owner:

If the owner is required to cancel the stay before its start date, they must inform the tenant by phone or email at least 8 days before the scheduled arrival date. 

The tenant will be reimbursed the amounts paid within 8 days, without prejudice to any claim for compensation for potential damages suffered. No compensation will be paid to the tenant under any circumstances.

 

Article 6 – Rates and Payment

All prices for services provided on the booking page are listed in Euros (€), including VAT (all taxes included), excluding local and tourist taxes.

In the gîte formula, breakfasts can be ordered as an extra: €10 for a sweet breakfast per person. The order must be placed at least 7 days before the start of the stay, subject to the owners’ availability.

The tourist tax, collected by the municipality, is set by the municipality and must be paid directly on-site.

The prices displayed on the booking page may be changed at any time without prior notice. These changes do not apply to reservations that have already been confirmed.

The payment of the deposit is made at the time of booking, directly on the website. www.lespatisnormandie.fr  or via a payment link sent by email following a reservation made by phone or email.

Payment conditions: 30% at the time of booking and 70% 30 days before arrival at the gîte.

Additional services must be paid at the end of the stay directly to the owner. The accepted payment methods are credit cards and cash.

Please note: as soon as the tenant takes possession of the premises (entry into the apartment), responsibility for any damage caused within the apartment is transferred to them.


Article 7 – Arrival

Arrivals must take place on the day specified in the booking confirmation, between 5:00 PM and 8:00 PM. 
In case of a delay or change in the arrival time, the tenant must inform the owner in advance. The owner is not obligated to accept the tenant before the scheduled arrival time.

CHECK-IN ou CHECK-OUT :  We add an additional fee based on your arrival time.

– Between 8:00 PM and 9:00 PM: €30

– Between 9:00 PM and 11:00 PM: €50

– After 11:00 PM: €100


Article 8 – Pets


Pets are allowed subject to prior approval from the owners, with an additional fee of an additional fee of €10 per stay and per pet. The use of beds, armchairs, and sofas is prohibited for pets. 

Any damage or soiling caused by the pet will be charged.

In case of non-compliance with this clause, the owner’s refusal to accept the tenants and their pets cannot be considered a modification or termination of the contract initiated by the owners. 

Therefore, no refund will be issued in the event of an early departure by the guest.


Article 9 – Use of the gîtes, common areas, the Estate, and available facilities

In order to ensure the tranquility of the premises and your comfort, you agree to abide by the house rules outlined in these Terms and Conditions, as well as those mentioned in the gîte(s) you occupy. Please note that:

  • All gîtes, the Press House, and the pool room are non-smoking, and vaping is also prohibited.
  • The tenants agree to return the gîte in the condition in which they found it and to report any damage that occurred.
  • Minors, especially young children, are under the exclusive responsibility of their parents or guardians, particularly on the Estate, near the pond, and at the pool.
  • It is imperative to only dispose of the provided toilet paper in the toilets. The sewage system cannot handle wipes, sanitary towels, tampons, condoms, etc.
  • Access to the jacuzzi is prohibited for minors, for safety and well-being reasons.


Article 10 – Use of the Pool and Jacuzzi

The pool is heated to between 28 and 29 degrees during the off-season, from May to the end of September. Access is secured by an alarm.

In accordance with French regulations regarding the use of family pools open to guests, and to prevent accidents, particularly for children, guests must adhere to the pool rules:

  • The use of the pool implies acceptance of these rules.
  • The pool is accessible from 9:00 AM to 8:00 PM. Swimming is prohibited at night.
  • The pool is family-oriented and is reserved exclusively for family members and individuals staying in the gîte.
  • The owners remind guests that the pool is not supervised.

  • Children under the age of 12 must be accompanied by an adult parent or guardian while swimming. The use of the pool by children remains the responsibility of their parents.
  • The pool area is a place of tranquility and relaxation. Running, diving, roughhousing, or playing music is strictly prohibited. Bulky inflatable objects (boats, etc.) are also not allowed.
  • Eating around the pool is prohibited. Only unbreakable glasses (plastic) are allowed.

Users also agree to:

  • Wear a swimsuit exclusively for swimming.
  • Take a shower before swimming and avoid swimming after applying sunscreen or tanning oil. A shower is available near the pool.

In accordance with regulations, the pool is equipped with a cover and a motion detection alarm during closing hours.

Reminder of the jacuzzi rules:

  • Take a shower before entering the jacuzzi, and the use of any creams is prohibited.
  • The jacuzzi is a place of tranquility and relaxation. Jumping, shouting, playing music, or eating is strictly prohibited. Only unbreakable glasses are allowed.

 They are accessible year-round, except during maintenance periods..


Article 11 – Use of Fitness Equipment (Reserved for adult guests)

To ensure safety and proper use of the equipment, the use of the fitness machines in the “Pressoir” is reserved exclusively for adult guests (18 years and older).

By using this equipment, you agree to adhere to the following rules:

  1. Responsible use : The machines must be used responsibly and in accordance with their operating instructions. Modifying or altering the equipment is prohibited.

  2. Sécurity : Each user must ensure that the equipment is in good working condition before use. In case of doubt, please contact the owners for any questions or in the event of a malfunction.

  3. Showers : We recommend taking a shower before using the machines for hygiene reasons.

  4. Appropriate behavior : Any reckless or noisy behavior, or actions that could damage the equipment, are prohibited. It is important to respect the space and avoid disturbing other guests while using the facilities.

  5. Respect for schedules : The fitness equipment must be used during the designated hours (subject to the access conditions specified for each gîte). Use outside these hours may be prohibited to maintain the tranquility of the premises.

  6. Risks and responsibilities : In the event of injury or accident while using the equipment, the responsibility lies solely with the user. The owners cannot be held liable for any incidents or injuries related to the use of the fitness equipment.

  7. Condition of the property : At the end of each session, users are asked to return the equipment to the condition in which it was found (cleaned and tidied). Any damage or deterioration may result in additional charges.


Article 12 – Complaints & Disputes

Any complaint related to the rental or stay must be sent to the owner by registered letter with acknowledgment of receipt within 3 days following the end of the stay, in order to attempt to resolve the dispute amicably.

In the event of a persistent disagreement, the parties may submit the dispute to the competent court in Alençon, which will decide on the next steps to be taken regarding the request.


Article 13 – Intellectual Property

All elements of the site lespatisnormandie.fr are and remain the intellectual and exclusive property of lespatisnormandie.fr

No one is authorized to reproduce, exploit, rebroadcast, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of lespatisnormandie.fr


Article 14 – Personal Data

lespatisnormandie.fr  reserves the right to collect nominative information and personal data concerning you. They are necessary to manage your order, as well as to improve the services and information that we send to you.

They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and personal data concerning you, directly on the website.


Article 15 – Archiving and Evidence

lespatisnormandie.fr will archive rental contracts and invoices issued on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code.

The computerized records of lespatisnormandie.fr  will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
